You / Your = the purchaser/client – any real or legal person placing an order for goods from M&H
M&H = Martin & Howe Antiques and Interiors
Goods = Goods and/or services ordered by You from M&H
General
1.These Terms and Conditions are the only terms on which M&H agrees to provide goods or services and apply to the exclusion of any other terms that You may seek to impose or incorporate, or which are implied by law, trade custom, practice or course of dealing.
2.The true colour of Goods may not exactly match that shown on Your device.
Textiles
3.The majority of M&H’s textile products are antique, vintage and/or pre-owned. This includes the fabric that M&H use to make its own range of cushion covers. Therefore, there may be signs of usage to the fabrics which will be described as accurately as possible by M&H. M&H is very happy to provide additional information and photographs upon request prior to purchase.
4.Due to the antique, vintage and/or pre-owned nature of M&H’s textile products, M&H are unable to provide or guarantee the fibre content. Therefore, (unless otherwise stated) all textile products are sold by M&H as made of an “unspecified textile composition” and/or “mixed fibres”.
5.All M&H’s cushions are supplied with a new feather cushion pad, and each cushion pad has a sewn-on label detailing the fire safety regulations to which it complies. Do not remove this label from the cushion pad, and please refer to the care instructions printed on it.
6.You are recommended to seek professional cleaning advice prior to undertaking the cleaning of Goods. M&H does not accept liability for any textiles that have sustained damage through cleaning or otherwise after delivery.
Ordering and Delivery
7.All orders are subject to availability. M&H will contact You to confirm M&H has received Your order, and to confirm it has been accepted.
8.Goods will be released for delivery once full payment has been received.
9.If the supply of Goods is delayed by an event outside M&H’s control, M&H will contact You as soon as possible to let You know what M&H can do to reduce the delay. M&H will not compensate You for the delay, but You can contact M&H at charlotte@martinandhowe.co.uk and receive a refund for any Goods You have paid for, but not received within a reasonable time frame.
10.All prices quoted by M&H are accurate at that point in time, and inclusive of UK sales tax at the current rate - any additional taxes remain Your responsibility.
11.The listed price does NOT include delivery (unless explicitly stated – at which point this would then be reconfirmed at point of purchase in writing) – Delivery/collection must be purchased/organised separately to product purchase.
12.You are welcome to make Your own delivery arrangements. In this instance, You shall be responsible for all costs, and will take responsibility for the goods from when they are handed over to Your appointed carrier.
13.M&H is unable to deliver outside of the UK but can deliver to your appointed UK courier for you to arrange onward transit.
14.M&H are not responsible for delays due to customs.
15.It is Your responsibility to ensure that all the delivery information provided to M&H is correct.
16.You should inspect Goods upon receipt and check that everything specified on the invoice is included, and that no items are damaged.
17.In the unlikely event an item is delivered and arrives with damaged packaging, it is a requisite by many insurance companies used by shippers/couriers that the following is undertaken as soon as possible:
I.Photographs taken of the packaging/box before being opened and emailed to M&H
II.No packaging/boxes must be destroyed or cut as these may need to be viewed
III.Photographs taken of the item (if damaged) and emailed to M&H
Returns Policy
18.Without limitation to Your statutory rights, if You have purchased Goods remotely
I.You can return them for no reason at Your own expense if You notify M&H within 14 days of receipt; or
II.You can return damaged or defective Goods at M&H’s reasonable expense if You notify M&H of the damage within a reasonable period of time following receipt. Please contact M&H at charlotte@martinandhowe.co.uk if You need to do this.
19.Any refund will be made no later than 14 days after the day M&H receives the Goods back from You.
20.M&H is not responsible for any losses You suffer caused by M&H, in particular:
I.An unexpected loss – i.e. It was not obvious that it would happen and nothing You said to M&H before M&H accepted Your order meant M&H should have expected it (so, in the law, the loss was unforeseeable); or
II.An avoidable loss – Something You could have avoided by taking reasonable action/care, including following any specific M&H instructions for use (if required/provided); or
III.A business loss – a loss relating to Your use of Goods for the purposes of Your trade, business, craft or profession.

21.From time-to-time M&H’s website / social media feeds may also include links to other websites. These links are provided for Your convenience to provide further information. They do not signify that M&H endorses the third party, and M&H has no responsibility for the content of the linked information.
Data Policy
22.M&H is committed to ensuring that Your privacy is protected. M&H considers the privacy and protection of its clients’ data, both business and personal, to be of the utmost importance.
23.M&H needs to know Your name, postal and billing address, e-mail address and telephone number in order to send Goods to You.
24.M&H may also request information regarding Your interests and preferences but will only do so where M&H have lawful grounds and legitimate business reasons for doing so.
25.M&H may also wish to provide You with information about new products, changes to M&H’s products and services, as well as events and other services and products which may be of interest to You. If You would rather not receive this information, please email charlotte@martinandhowe.co.uk
26.M&H will never share Your personal data with any third parties except where M&H is required to do so by law or for delivery purposes (e.g. delivery companies/couriers to enable Your delivery).
